Terms of WiFi

By clicking “Sign On” and using Canberra Racing Club’s (CRC) wireless local access network services (WiFi) you acknowledge and agree to the following terms:

Acceptance of Terms

1. By accessing and using the Wi-Fi, you confirm that you have read, understood, and agreed to be bound by these terms. 

User Warranties and Obligations

1. You warrant that you will:
   1. ensure your usage is reasonable and does not degrade the quality or performance of the service of other users;
   2. not collect, use, disclose or store another person’s personal information without their consent, in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs);
   3. not interfere with, disrupt, or attempt to gain unauthorised access to CRC’s or third party’s Wifi systems;
   4. not use the WiFi to send unsolicited communications or otherwise engage in activity that compromises network security;
   5. not use the WiFi for unlawful file sharing, hosting of websites, or establishing additional guest access points; and
   6. not store, transmit, distribute or access any material that is defamatory, obscene, threatening, infringing, harassing, offensive, discriminatory, promotes unlawful violence, or is otherwise illegal. 

Marketing Communications and Privacy

1. CRC may collect and use personal information (including device identifiers, session data, and any contact details you provide) for CRC marketing purposes.
2. You may opt out of receiving marketing communications from CRC at any time by following the methods described in each message.
3. CRC will handle your personal information in accordance with its Privacy Policy and the APPs under the Privacy Act.

Indemnity

1. You indemnify and keep indemnified CRC, its officers, employees, agents and contractors against all loss, damage, claims, liabilities, fines or expenses arising out of or in connection with:
   1. your use of the WiFi; and 
   2. any breach of these Terms of Wifi.

CRC’s Rights and Disclaimers

1. CRC: 
   1. makes no representation or warranty as to the availability, quality, or performance of the WiFi;
   2. excludes all liability for any loss, damage or injury (whether direct or indirect) suffered by any person arising out of or in connection with the use of the WiFi;
   3. may monitor your usage for operational, compliance, or security purposes; and 
   4. may suspend or terminate your access to the WiFi at any time, in its sole discretion and without notice.
